The service that the studio provides is to
allow our clients to choose upon what they wish to have for their commission.
The commission is a digital piece of art that will vary upon non-traditional
medium [digital: paint, ink, pencil, chalk, charcoal, etc] as well the genre
[cube, cartoony, anime, realism, retro, etc.] of style that the artist will use. The client may
also purchase upon "commission extras" that add to the commission. These
extras are mentioned in the main Commission Information page and also in
this agreement.
About: All commissions will be digital, although this does not limit upon
medium and style that the artist can use. The commission will vary upon
non-traditional medium [digital: paint, ink, pencil, chalk,
charcoal, etc] as well the genre [cube, cartoony, anime, realism,
retro, etc.] of style that the artist will use. and the artist can even give the commission a
transparent background.
Turnaround time: The duration it will take for the artist
to complete the commission will depend upon how much detail that it
requires. The guarantee for the time would be less than 3 weeks.
Order Form Instructions: To order upon your commission
you will first be required to fill in an order form. The artist
would much appreciate it if the client is clear and descriptive upon
the commission information.
Character Commissions: Each client will be allowed to request 1 character for their
single commission. If the client wanted to add additional characters, they will
need to purchase $5.00 for each additional character. The limit of
additional character's is [3].
Clients: The artist will only serve three clients at a time. [order form will
be disabled when commission status is full/closed]

Payment: The rates of the commission are not negotiable.
the artist will not accept requests upon anything relevant to begging for any
negation.
Methods of payment: The payment can be using traditional
mailing methods of sending cash/check with a secure envelope, or electronically
with PayPal.
Extras for the commission: The extras for the commission
that client can optionally choose in addition to the commission itself.
There are only two extras that the artist (the artist) will be offering:
• Transparent background [$1.00] • an additional character
[$5.00].
Gallery placement: all commissions will be automatically
referenced in the commission section of the gallery. The client can
feel free to ask about having their commission not displayed upon the
gallery.
TERMS
RESERVATION OF RIGHTS: All rights are
retained by the Artist, including any electronic rights or usage,
and including, but not limited to, all rights in the work itself.
Technically, all rights not specifically signed over remain with the
artist.
Copyright: Artist reserves all reproduction
rights, including the right to claim statutory copyright, in the
art work. Nothing in this agreement shall be construed as a transfer of
the underlying intellectual property. Artist retains all rights in
copyright and other intellectual property rights available to the
art work.
REVISIONS: Revisions may be made only by
the Artist at the sketch stage. You can feel free to ask for any
changes to the commission itself.
Sketch Stage: The piece will start off as a rough draft, the artist will display the rough draft of the commission to the
client to see if the commission information is correct. The artist will keep the rough draft of the commission.
After the sketch of the commission has been approved by the
client, the payment for the commission will take place.
Commission Payment: As stated above, all
payments for the commission will take place during the sketch stage.
Cancellations/Refunds: Cancellations upon
the commission will result in a fee. Fees are due based on the
amount of work that is completed. The Refund will be deducted by the cancellation
fee. There is no fee if the client chooses to cancel the commission
before they have paid during the sketch stage [see above
statements].
What will happen if a client does not pay?
If the client does not pay
for their commission during the Sketch Stage, the artist will not
start on the commission until the client has paid. Once payment has
been made in full the illustration will be
delivered via email in a zip file. Please note that images are kept
only file for a period of six months.
Retrieval upon the Commission: All
commissions will be retrieved electronically into an attachment
which is a zipped folder of the work itself by e-mail. This ensures
that the piece will be securely sent, otherwise the client can
choose to order a CD that will have a copy of the piece [all CDs
will be CD-R]. The CD is free but the shipping will be [$2.00].
Artist's Signature: Each piece will retrieve a signature from the
artist upon the work
as well date of completion. All signatures will take place within the
lower-right corner piece of the work.
Profit Restrictions: The client may be
commissioning the picture, although the rights to the image stay
with the artist, so the client cannot use it in any way that would
generate profit.
Commission Uses/Permissions: The client may have the commission
displayed anywhere they wish [Examples: non-profit websites, posters, or desktop
background]. The client is permitted to make reproductions of the commission
only for non-profit uses and also please keep the artist signature/stamp attached
when cropping or configuring the commission.
Confidential Statement: All client information
is kept confidential.
